New laws have now come into effect to protect the rights of temporary overseas workers and ensure that Australian wages and conditions are not undermined.

The new laws require that all workers on subclass 457 visas must be paid market salary rates. Employers currently paying less than market rates have until January 1, 2010 to commence paying market rates.

The new laws allow the Tax Office to disclose information to the Department of Immigration and Citizenship and the Fair Work Ombudsman to ensure correct salary levels are being paid to visa holders.

The sharing of information among the different Government departments will provide an effective deterrent to any unscrupulous employers by ensuring issues come to light quickly and are dealt with appropriately.

Employers found to be in breach of their obligations face fines of up to $33 000 and may have their ability to sponsor foreign workers suspended.
